Affidavit of Support Issues
Sometimes, especially in family-based petitions, the isseu arises of how to resolve
affidavit of support problems. In most cases, the U.S. citizen spouse who wants to
sponsor a foreign spouse or fiancee' for a  green card must produce evidence that
he/she meets 125% of the latest poverty line guidelines, and attach several
documents including complete federal tax return for the most recent tax year, letters
verifying current employment, and other evidence of assets.

This could sometimes raise thorny problems, for example when the evidence
submitted in support of the I-864 affidavit does not meet the required financial
threshold, or could cast a shadow on the bona fide of the marriage (For example, sa it
sometimes happen, when the U.S. citizen filed as single and not as a married person).

Do not let this be an obstacle to your green card petition.  Not all these problems can
be overcome, but in may cases an ounce of prevention is worth a pound of cure and
well worth the intial consultation fee with an immigration attorney.

Be aware of scam artist that will take your money  only to let you find out later that your
petition is destined for denial. Many poorly written petitions are approved for initial filing
only to discover at the time of a request for additional evidence or at the adjustment
interview that the alien has a major problem and that the whole petition will be denied.
Unfortunately, many individuals not licensed to practice law ("
notarios") have been
know to "fee in" an unwinnable case only to get a several thousand dollar retainer and
then disappear.
